Terms of Service

Effective date: May 7, 2026

These Terms of Service ("Terms") govern your use of the Aureli AI mobile application ("App") operated by Aureli AI ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use Aureli AI. By creating an account, you represent that you meet this age requirement and that you are not located in a jurisdiction where use of the App is prohibited or restricted by law.

2. Account

You are responsible for maintaining the security of your account credentials. You agree to provide accurate information during registration and to keep it up to date. You may not share your account or allow others to access it. We may suspend access if we reasonably believe your credentials have been compromised or used in violation of these Terms.

You may create only one account. Repeated creation, deletion, and recreation of accounts, or any pattern of activity we reasonably consider abusive (including attempts to repeatedly claim free trials, evade restrictions, or manipulate features), is prohibited and may result in suspension or termination of your account without refund.

3. Subscription & Payments

Plans

Continued access to premium features requires an active subscription. Available plans:

• Weekly — $3.99 per week
• Annual — $39.99 per year

Prices are listed in U.S. dollars. Local currency, taxes, and exact charge amounts are determined by Apple App Store or Google Play at checkout based on your region.

Free Trial

If a free trial is offered for your selected plan, it begins when you start the subscription through the App Store or Google Play. Unless canceled before the trial ends, the subscription will automatically convert to a paid subscription at the price shown at purchase.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period (weekly or annual) unless canceled at least 24 hours before the end of the current period. The renewal is charged to the payment method linked to your Apple ID or Google account. You can manage or cancel your subscription at any time through your device's App Store or Google Play settings.

Refunds

Refund requests are handled by Apple or Google according to their refund policies. We do not process refunds directly. Partial-period refunds are not provided unless required by applicable law.

Price Changes

We may change subscription prices for future renewal periods. We will notify you in advance through the App or by email and, where required by law or by App Store / Google Play rules, obtain your renewed consent. If you do not accept a new price, you may cancel before the next renewal; the existing period remains at the original price.

4. EU/UK Consumer Rights & Right of Withdrawal

Nothing in these Terms limits or excludes your mandatory consumer rights under the laws of your country of residence. For users in the European Economic Area (which includes EU member states, Norway, Iceland, and Liechtenstein), the United Kingdom, or Switzerland, you normally have a 14-day right of withdrawal for digital services purchased online. By starting to use the App's premium features (including any free trial) immediately upon subscribing, you expressly request immediate performance of the service and acknowledge that your right of withdrawal is lost once the service has been fully provided, in accordance with applicable consumer law (including Article 16 of EU Directive 2011/83/EU and equivalent national law).

5. Apple App Store & Google Play Terms

These Terms are an agreement between you and Aureli AI only, and not with Apple Inc. or Google LLC. Aureli AI alone is responsible for the App and its content.

If you obtained the App from the Apple App Store, you acknowledge and agree that:

• Apple has no obligation to furnish any maintenance or support services for the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your use of it, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
• In the event of any third-party claim that the App or your possession or use of it infringes that third party's intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of the claim.
• You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms of agreement when using the App (including your wireless data plan).
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

If you obtained the App from Google Play, you acknowledge that Google is not a party to these Terms and is not responsible for the App. Your use of the App through Google Play is also subject to the Google Play Terms of Service.

6. Nature of the Service

The App provides cosmetic skin appearance tracking and AI-powered visual observations. It is a wellness and beauty tool — it is not a medical device , does not perform medical diagnoses, and is not intended to replace professional dermatological care.

All skin scores, observations, and recommendations are based solely on visual appearance analysis and should be treated as cosmetic insights, not clinical assessments.

7. No Medical Advice

Nothing in the App constitutes medical advice, diagnosis, or treatment. The App cannot detect, diagnose, or monitor skin diseases, cancers, infections, or any medical condition. Always seek the advice of a qualified dermatologist or healthcare provider with any questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of information provided by the App.

8. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to reverse-engineer, decompile, or extract the source code of the App
• Scrape, crawl, or use automated tools to access the App or its data
• Upload malicious content or attempt to compromise the App's security
• Impersonate another person or provide false information
• Use the App to scan or analyze anyone other than yourself without their consent

9. AI-Generated Content & Limitations

The App uses artificial intelligence to generate skin analysis, routines, recommendations, daily cards, reports, and chat responses. AI analysis has inherent limitations:

• Results may vary based on lighting, camera quality, and photo angle
• AI observations are approximate and may not reflect actual skin health
• Scores and trends are relative comparisons, not absolute measurements
• The AI may produce inaccurate or inconsistent results

This content is:

• For informational purposes only — it is not medical advice
• Not a substitute for professional care — consult a dermatologist for medical skin conditions
• Generated by AI — results may vary and are not guaranteed to be accurate

We do not warrant that AI-generated recommendations will produce any specific results. You use AI features at your own discretion.

10. Biometric Data & AI Processing

The App processes facial images to generate skin metric scores. To perform skin analysis, your face photos are transmitted to third-party AI providers ( Google and OpenAI ) for processing. These providers process your photos solely for the purpose of returning skin analysis results and do not retain them beyond the processing session.

By default, we do not store your raw facial photos on our servers — only the derived skin metric scores and textual observations are saved to your account. You may opt in to save your scan photos to your account in the App settings; in that case, the photos are stored in your private account and you can delete them at any time.

We do not perform facial recognition or biometric identification. Photo analysis is limited to skin surface quality assessment. By using the scan feature, you consent to this processing as described in our Privacy Policy . You may withdraw consent at any time, which will disable the scan feature.

11. International Data Transfers

The third-party AI providers we use (Google or OpenAI) and certain cloud infrastructure providers are located outside the European Economic Area, primarily in the United States. By using the App, you acknowledge that your data may be transferred to and processed in such countries. Where required by law, these transfers are protected by appropriate safeguards under applicable data protection law, including the European Commission's Standard Contractual Clauses and providers' adherence to recognized frameworks (such as the EU–U.S. Data Privacy Framework). You may request a copy of the relevant safeguards by contacting us at info@getaureli.app .

12. Data Retention

Your photos, skin analyses, routines, and other personal data are retained until you choose to delete them. There is no automatic expiry. You may delete all your data at any time from the Profile screen. Account deletion permanently removes all associated data from our systems.

13. Your Rights (GDPR & Equivalent)

For users in the European Union, United Kingdom, and other jurisdictions with equivalent data protection laws, you have the right to:

• Access your personal data (via "Export My Data" in Profile)
• Rectify inaccurate data (via editing your Profile)
• Delete your data (via "Delete" in Profile)
• Export your data in a portable format
• Withdraw consent for photo processing at any time
• Lodge a complaint with your local data protection supervisory authority

15. Intellectual Property & License Grant

Subject to your compliance with these Terms, Aureli AI grants you a limited, non-transferable, non-exclusive, non-sublicensable, revocable license to install and use the App on Apple or Android devices that you own or control, solely for personal, non-commercial use. All rights not expressly granted are reserved.

The App, its design, code, AI models, content, and branding are owned by Aureli AI and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

You retain ownership of your personal data (scan results, logs, preferences). By using the App, you grant us a limited license to process this data to provide our services.

16. User Content

If you share glow cards or other content generated by the App, you are responsible for that content. You grant us permission to use shared content for promotional purposes only with your explicit consent.

17. Third-Party Services

The App integrates with third-party services including:

• Apple and Google for authentication and payments
• Google or OpenAI for AI skin analysis
• Product and ingredient databases for ingredient lookup
• Cloud infrastructure providers for data storage

We are not responsible for the availability, accuracy, or practices of third-party services.

18. Service Availability & Modifications

We strive to keep the App available but do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue any part of the App, including specific features, at any time, with or without notice. If we discontinue paid features that materially affect an active subscription, we will provide a pro-rata refund for the unused portion where required by applicable law.

19. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that:

• The App will be available at all times without interruption
• Skin analysis results will be accurate or complete
• Following AI-generated routines will produce specific outcomes
• Product ingredient data from third-party sources is current or accurate

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our warranties are limited to the minimum scope and duration permitted by applicable law.

20. Limitation of Liability

To the maximum extent permitted by law, Aureli AI and its founders, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to damages related to health decisions made based on App information. Our total aggregate liability for any direct damages shall not exceed the greater of (a) the amount you paid for the App in the 12 months preceding the claim, or (b) USD 50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation). If applicable law does not permit the full exclusion or limitation set out above, our liability is limited to the maximum extent permitted by such law.

21. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Aureli AI and its founders, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the App; (b) your violation of these Terms or any applicable law; (c) your violation of any third party's rights, including privacy or intellectual property rights; or (d) any content you submit, share, or generate through the App. This section does not apply where prohibited by mandatory consumer protection law.

22. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the App. Upon termination, your right to use the App ceases immediately. Data deletion follows the timeline described in our Privacy Policy .

23. Dispute Resolution

Before bringing any formal legal claim, you agree to first contact us at info@getaureli.app and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved this way. If we cannot resolve the matter informally, the dispute will be handled under the Governing Law and forum set out below. Nothing in this section limits your right to bring proceedings in your country of residence where required by mandatory consumer protection law, or to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr .

24. Governing Law & Jurisdiction

These Terms are governed by the laws of the country in the European Union where Aureli AI is established, without regard to conflict of law principles. The competent courts of that jurisdiction shall have exclusive jurisdiction, except that (a) consumers may bring proceedings in the courts of their country of residence where required by mandatory consumer protection law, and (b) we may bring proceedings to enforce our intellectual property rights in any competent court.

25. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email at least 14 days before they take effect, where reasonably practicable. Continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not accept the changes, you may stop using the App and cancel your subscription.

26. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy , constitute the entire agreement between you and Aureli AI regarding the App and supersede any prior agreements.

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be replaced by an enforceable one that most closely reflects the original intent.

No Waiver

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, with notice to you.

Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, war, civil unrest, pandemic, labor disputes, internet or telecommunications outages, government actions, or failures of third-party service providers.

Language

These Terms are provided in English. Translations are for convenience only; the English version controls in case of conflict.
